VCAT proceedings — VCAT have now recommenced Fee Recovery Hearings

Your Owners Corporation must ensure that all Owners pay their fees and to pursue any arrears in good faith. In the event that an Owners Corporation does not wish to offer payment plans, or a Lot Owner defaults on a payment plan, Strata Plan suggest that VCAT proceedings be issued sooner, rather than later.

The Victorian Civil and Administrative Tribunal (VCAT) has announced that it will recommence fee recovery hearings via telephone conference from, 23 April 2020 until further notice.

VCAT will notify the parties with details of the scheduled telephone conference hearing beforehand. Material supporting the application must be filed with VCAT two (2) days prior to the hearing. However, it is not yet known how much notice will be provided once a date has been allocated.

With many cases recently adjourned, and new cases still being lodged, the longer the Owners Corporation waits to file the proceedings, the longer it will have to wait for a hearing.
